Wills
What is a Will?
A Will is a legal document which allows you to decide what happens to your estate - your money, property and other possessions, after your death.
Why make a Will?
There are many reasons to make a Will - here are a few:
- Allows you to choose a Guardian for your children, should the parents die whilst they are young.
- Allows you to decide who will conduct your affairs after your death - the Executor.
- Allows you to decide who benefits from your Estate, instead of letting the Crown decide the direction of your possession - the Beneficiaries.
What happens if you don't make a Will?
Without a Will, the rules of Intestacy would be followed - which is a rigid order which must be followed - for distribution.
LPA's (Lasting Power of Attorney)
What is a LPA?
An LPA is a legal document which allows you as the Donor to appoint people you Trust - your Attorneys - to make decisions on your behalf if you were unable to do so or were to lose mental capacity.
The LPA is used whilst you are alive and then the Will takes over on your death.
Why have an LPA?
Your Attorneys can help you in running your Property & Finances, in the unfortunate event that you are no longer able to do so. For example, if you were involved in a road accident, then you can ask your attorneys to help with daily chores, which you cannot at this stage carry out yourself. They can also go the Bank on your behalf to pay bills etc.
In the event of losing mental capacity, they would be able to help with all your and Health & Welfare matters. For example, arranging your Doctors appointments, administering your tablets etc.
What happens if you don't have have LPA?
Without an LPA and if you lose mental capacity, your loved ones would have to go through the Court of Protection to ask for authorisation to run your finances and health affairs. This would be a costly and lengthy process - however, by having an LPA in place, this could have been avoided.


Probate and Estate Administration
What is Probate and Estate administration?
Probate allows someone (usually the Executors) the legal right to deal with someone's Estate - made up of money, property, possessions - when they pass away. Once they have the Probate, they can administer the Estate, which is the legal process of managing a person's financial affairs, by paying off any debts or taxes (IHT) to distributing the assets to the beneficiaries named in the Will.
Document Storage
What is Document Storage?
Once you have had your Wills and LPA's written, they can be stored, with other legal documents, at a secure storage place, away from your home in the event of a fire. The documents are fully insured and can be returned to your Attorneys or Executors as and when required.
